Isn't Gerrymandering illegal?

Here in North Carolina the Republican controlled legislature plans to redraw the districts to ensure Larry Kissell and Mel Watt's districts are eliminated. They plan to consider race when they redraw the districts. My Rep. Patrick McHenry (an idiot) even said that "Larry Kissell and Mel Watt are serving their last terms in Congress." Shouldn't this be illegal?
